SHCA Facility Rental Agreement

Definitions

"SHCA"
The Signal Hill Community Association.
"Renter"
The person whose name, email, and phone are on the booking (the "Booking Party").
"Facility"
The SHCA facility identified in your booking, multi-purpose room, park gazebo, vendor window, outdoor rink, or another SHCA-managed space.
"Rental Time"
The start and end times shown on your booking.
"Group"
The Renter, anyone the Renter invites or admits to the Facility, and anyone participating in the event.
"Released Persons"
SHCA and its directors, officers, representatives, contractors, agents, employees, and volunteers, and the owner of the land on which the Facility sits.
"Released Matters"
Any injury, death, property damage, economic loss, liability, or other loss suffered by any member of the Group, arising from or relating to the event, the booking, or use of, entry onto, or presence at any part of the Facility during the Rental Time, including from the design or condition of the Facility, any negligence of the Released Persons, failure to maintain, hazards or defects, failure to warn, occupier's liability, strict liability, breach of statute or by-law, or breach of contract.

Terms

  1. Use of the Facility. SHCA authorizes the Renter to use the Facility during the Rental Time for the event described in the booking (the "Event").
  2. Payment. Rental fees are paid in full at the time of booking via the secure Stripe payment form on shca.ca. If you cannot pay by card, contact info@shca.ca to arrange another method before the booking is confirmed.
  3. Damage deposit. Some facilities require a refundable damage deposit. We hold the deposit on your card (no charge unless damage occurs) and release the hold within a few days of the event if the Facility is returned in the condition it was rented. If damage requires repair or replacement, SHCA may capture all or part of the deposit toward that cost and will email an itemized explanation.
  4. Cancellation and refunds. Cancellations 48 hours or more before the Rental Time start receive a full refund of the rental fee (Stripe's processing fee is non-refundable). Cancellations inside 48 hours are non-refundable unless SHCA cancels the booking. If SHCA cancels for any reason (including weather for outdoor facilities), you receive a full refund of the rental fee plus any deposit hold is released.
  5. Release and waiver. The Renter releases and discharges each of the Released Persons from all claims, demands, actions, or causes of action that the Renter or any member of the Group has or may in future have for or relating to any of the Released Matters (including any claim for contribution or indemnity). The Renter assumes all risks relating to the Released Matters, agrees that the Released Persons shall not be liable for any claims arising from any of the Released Matters, waives all claims (joint or several) against the Released Persons, and will not commence or maintain any demands or suits against any of the Released Persons relating to any of the Released Matters.
  6. Indemnity. The Renter indemnifies each of the Released Persons against any liability, cost, or expense suffered or incurred in relation to any claim or demand by any person, including any member of the Group, relating to any of the Released Matters, and shall promptly notify SHCA of any such claims, demands, or facts that may give rise to them.
  7. Compliance with law. The Renter will comply with all applicable laws, by-laws, and health restrictions (including permits or licences relating to the Event), and will use best efforts to ensure that all Group members comply and behave in an orderly manner during the Event, and to ensure the safety and well-being of all Group members while using any part of the Facility.
  8. Facility rules. The Renter acknowledges and agrees to the SHCA's posted rules and regulations for the specific Facility being rented (posted at the Facility and available on request from info@shca.ca).
  9. Personal information. The Renter consents to SHCA's collection and use of the personal information provided on the booking form for these purposes: confirming the booking, contacting the Renter about the Event, processing payments and refunds, recording use of the Facility, and other purposes permitted by Alberta's Personal Information Protection Act.   10. Entire agreement. The terms of this agreement cannot be waived or modified except by further written agreement signed by an authorized SHCA representative, and no SHCA representative has the authority to orally waive or modify any of the terms in this agreement or their effect. This agreement, together with the specific facility rules and the SHCA privacy policy, is the entirety of the agreement between SHCA and the Renter relating to the use of the Facility.

By checking the box at booking time, the Renter confirms they have read, understand, and agree to the terms above and accepts the same on behalf of all members of the Group. Breach of any of the terms may result in immediate termination of the booking at SHCA's discretion.
